In this regards, PTTEP would like to communicate to our valued vendors on the "the Guidelines on Appropriate Internal Control Measures for Juristic Persons" issued by The National Anti-Corruption Commission (NACC), which can be downloaded from https://www.nacc.go.th/abas
The main contents of the guideline are as follow:
- Understanding bribery offences and liabilities of juristic persons
- Fundamental Principles of appropriate control measure to prevent briberies comprising of 8 principles as below:
1. Strong, visible policy and support from top-level management to fight bribery
2. Risk assessment to effectively identify and evaluate exposure to bribery
3. Enhanced and detailed measures for high-risk and vulnerable areas
4. Application of anti-bribery measures to business partners
5. Accurate books and accounting records
6. Human resource management policies complementary to anti-bribery measures
7. Communication mechanisms that encourage reporting of suspicion of bribery
8. Periodic review and evaluation of anti-bribery prevention measures and their effectiveness

บริษัท ปตท.สำรวจและผลิตปิโตรเลียม จำกัด (มหาชน) หรือ ปตท.สผ. มุ่งมั่นในการดำเนินธุรกิจอย่างโปร่งใส และยึดถือการปฏิบัติต่อผู้ส่วนได้ส่วนเสียทางธุรกิจอย่างยุติธรรมตามหลักการกำกับดูแลกิจการที่ดีและจริยธรรมธุรกิจ ตลอดจนสนับสนุนการต่อต้านการคอร์รัปชัน ปตท.สผ.ในฐานะรัฐวิสาหกิจตามพรบ.การจัดซื้อจัดจ้างและการบริหารพัสดุภาครัฐ พ.ศ. 2560 และสมาชิกแนวร่วมปฏิบัติของภาคเอกชนไทยในการต่อต้านการทุจริต (CAC) ได้พัฒนาระบบป้องกันคอร์รัปชันขององค์กรอยู่เสมอ เพื่อให้มั่นใจว่าได้ดำเนินการตามหลักการกำกับดูแลกิจการที่ดีและกฏหมายต่างๆที่เกี่ยวข้องอย่างครบถ้วน ซึ่ง ปตท.สผ. ตระหนักดีว่าผู้ค้าเป็นกลุ่มผู้มีส่วนได้เสียที่มีบทบาทสำคัญอย่างยิ่งในการสนับสนุนให้ ปตท.สผ. สามารถขับเคลื่อนองค์กรได้บรรลุตามเจตนารมณ์ดังกล่าว
ทั้งนี้ สำนักงานคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ (ป.ป.ช.) ได้ประกาศคู่มือแนวทางการกำหนดการควบคุมภายในที่เหมาะสมสำหรับนิติบุคคล ซึ่งสามารถดาวน์โหลดได้ที่ https://www.nacc.go.th/abas โดยมีเนื้อหาประกอบด้วย 2 ส่วนต่อไปนี้
ส่วนที่ 1:การอธิบายกฎหมาย มาตรา 176 และตัวอย่างกรณีศึกษา
ส่วนที่ 2: หลักการพื้นฐาน 8 ประการ ซึ่งเป็น มาตรการในการป้องกันการให้สินบนที่นิติบุคคลควรนำไปปฏิบัติและ ตัวอย่างการปรับใช้มาตรการฯ
1. การป้องกันการให้สินบนต้องเป็นนโยบายสำคัญจากระดับบริหาร สูงสุด
2. นิติบุคคลต้องมีการประเมินความเสี่ยงในการให้สินบน เจ้าพนักงานของรัฐ
3. มาตรการเกี่ยวกับกรณีมีความเสี่ยงสูงที่จะเป็นการให้สินบนต้องมี รายละเอียดที่ชัดเจน
4. นิติบุคคลต้องนำมาตรการป้องกันการให้สินบนไปปรับใช้กับ ผู้ที่มีความเกี่ยวข้องทางธุรกิจกับนิติบุคคล
5. นิติบุคคลต้องมีระบบบัญชีที่ดี
6. นิติบุคคลต้องมีแนวทางการบริหารทรัพยากรบุคคลที่สอดคล้อง กับมาตรการป้องกันการให้สินบน
7. นิติบุคคลต้องมีมาตรการสนับสนุนให้มีการรายงานการกระทำ ความผิดหรือกรณีมีเหตุน่าสงสัย
8. นิติบุคคลต้องตรวจสอบและประเมินผลการใช้มาตรการป้องกัน การให้สินบนเป็นระยะ
ปตท.สผ.ขอให้ผู้ค้าทุกท่านได้ทำความเข้าใจและนำคู่มือนี้มาปฏิบัติใช้ต่อไป
